Pada nomor laporan HI-O7.03.16.02.08 per tanggal 4 April 2018 itu, PT Kinantan Medan Indonesia dianggap telah melakukan tindak pidana melanggar Pasal 100 ayat 1 UU Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis.
Pelaporan ini merupakan buntut dari somasi yang dilakukan PT Pesemes Medan terhadap PT Kinantan Medan Indonesia yang telah menggunakan logo dan merek PSMS tanpa izin. Pada somasi yang dikeluarkan per tanggal 24 Maret 2018, surat peringatan juga diberikan kepada PT Liga Indonesia Baru (LIB) selaku penyelenggara Liga 1 dan DJ Sport Apparel selaku sponsor yang memproduksi dan memasarkan jersey PSMS.
Seperti dikutip dari Bola, PT Pesemes Medan pun memberikan deadline kepada PT Kinantan Medan Indonesia dan PT LIB untuk menyelesaikan masalah ini. Jika tidak ada titik terang, maka PT Pesemes Medan akan membawa kasus ini ke jalur hukum.
"Paling tidak dengan waktu satu minggu ke depan kami akan tetap membuka diri, membuka kesempatan kepada PT LIB selaku operator penyelenggara Liga 1, kemudian kepada PT Kinantan Medan Indonesia selaku manajemen yang membawa tim PSMS untuk datang ke kami," ujar Pengacara PT Pesemes Medan, Fadillah Hutri Lubis di Jakarta, Jumat (6/4/2018).
"Jika mereka tidak membuka diri tentunya kami akan menempuh upaya hukum. Kami kemarin sudah membuat pengaduan secara Pidana di Kementerian Hukum dan HAM. Kami juga akan mempertimbangkan untuk melakukan tuntutan secara perdata juga karena UU Nomor 20 tahun 2016 itu memungkinkan juga bagi kami untuk menuntut ganti rugi," lanjutnya.
"Termasuk itu di dalamnya kami akan mengajukan tuntutan operasional kepada hakim agar keberadaan PSMS Medan di Liga ini dihentikan kegiatannya. Artinya tidak diikutsertakan sebagai peserta dari Liga 1," tutupnya.
